Terms of service

Draft for review. A starting point written by the team, not legal advice. The sections marked to be completed need a decision before this platform is used by customers outside a trial.

What you are buying

A hosted instance of the software you chose, running on our servers, reachable at the address you picked. The plan you bought says what it includes and what it costs. You are not buying a licence to the software itself and you are not buying the servers.

Your account

You sign in with an account we create for you when you buy, and you choose your own password. Keep it to yourself: anything done with your account is done as you. Tell us at once if you think somebody else has it.

Paying

• The price, the currency and the billing period are the ones shown when you buy. Taxes are added where they apply.
• The trial, when your plan has one, is free and ends on the date shown in your instance list. A card is registered up front so the subscription can continue without interruption.
• Payments are taken by Stripe. Invoices, cards and cancellation are managed from Stripe's billing portal, which you reach from "My instances".
• If a payment fails, Stripe retries. If it keeps failing, the subscription is cancelled and your instance is suspended.

Cancelling

You can cancel at any time from the billing portal. Your instance keeps working until the end of the period you already paid for, and is then suspended. A suspended instance is deleted 30 days later, and we write to you 7 days before that. Export what you need before then: after the deletion the data is gone and cannot be recovered.

Your data inside the instance

It is yours. We hold it to run the service, we do not read it and we do not use it for anything else. What we do with the personal data of your account is in the privacy notice.

What we promise, and what we do not

• We keep the service running with reasonable care, we apply security updates, and we tell you about planned maintenance that will interrupt it.
• Service level, availability target and credits: to be completed. Until that section is filled in, no availability is committed.
• We do not promise that the software does something in particular for your business. It is offered as it is, with the features its own documentation describes.

What you may not do

Use the service to break the law, to send unsolicited email, to attack anybody, to hold content you have no right to hold, or to resell it as your own without an agreement with us. We may suspend an instance that is doing any of that, and we will tell you why.

Changes to these terms

If they change in a way that matters to you, we write to the address we have for you before the change takes effect. Continuing to use the service after that means you accept the new terms.
